Throughout his legal career, Joshua has developed extensive experience representing bankruptcy trustees in all facets of estate administration, including the litigation of adversary proceedings, liquidation of assets, objections to claims, preparation of civil and criminal referrals, and assistance with all other aspects of their case management and reporting duties, having served as counsel to bankruptcy trustees in over 1,000 cases. In addition to his work with trustees, Josh routinely advises and represents debtors, creditors, and other parties in interest across diverse bankruptcy proceedings. Represent a Chapter 7 trustee in ongoing complex cases converted from Chapter 11, obtaining after trial a contempt order and monetary award against the debtor’s principal, temporary incarceration of debtor’s principal for failure to purge contempt, substantive consolidation of estates, and recovery of nearly $2 million to date through litigation, settlements, and collection efforts. Represented a Chapter 7 trustee in a case involving a debtor operating a Ponzi scheme, obtaining denial of the debtor’s discharge, assisting the Florida Office of the Attorney General in the debtor’s criminal prosecution, and prosecuting clawback and other actions to recover avoidable transfers. Represented a Chapter 7 trustee in a case converted from Chapter 11, achieving distributions to unsecured creditors substantially exceeding those approved under the Chapter 11 plan, and successfully defended the conversion and trustee’s appointment on appeal. Represented a creditor in obtaining conversion of case from Chapter 11 to Chapter 7, as well as entry of contempt orders and judgments against the debtor’s principals for misappropriation of estate assets. Thereafter, represented the Chapter 7 trustee in related litigation, post-judgment collection efforts, and proceedings addressing the principals’ assertion of Fifth Amendment rights. Represented a Chapter 7 trustee in a cross-border insolvency proceeding, recovering over $1.1 million for the estate through asset sales, including real property in Colombia, and the settlement of numerous fraudulent and preferential transfer adversary proceedings. Represented a Chapter 7 trustee in the liquidation of a cargo company, including the sale of a 1,655-gross-ton general cargo vessel. Represented a Chapter 7 trustee in securing a $2.2 million settlement resolving litigation involving resulting trust and fraudulent transfer claims, and in obtaining bankruptcy court approval of the settlement over objections.
